Cookie Policy
Last Updated: September 2026
This Cookie Policy explains how Otavite ("we," "us," "our," or the "Company") uses cookies, pixels, web beacons, local storage objects, software development kits, and similar tracking technologies (collectively, "Cookies") on otavite.info and any related subOtavites, applications, and services (collectively, the "Service"). This policy applies to all visitors, registered users, trial users, and customers of the Service and should be read together with our Privacy Policy, our Terms and Conditions, and our Terms of Services, each of which is incorporated herein by reference.
Because the Service is operated from and offered primarily to individuals and businesses located in the United States, this policy is drafted to address the United States' notice-and-choice model of privacy regulation. The United States does not impose a general, blanket consent requirement for setting Cookies. Instead, applicable federal and state law — including the Federal Trade Commission Act, 15 U.S.C. § 45 (the "FTC Act"), the California Consumer Privacy Act as amended by the California Privacy Rights Act ("CCPA as amended by CPRA," Cal. Civ. Code § 1798.100 et seq.), and comparable state comprehensive privacy statutes — requires that we provide clear, conspicuous notice of our data practices and honor specific opt-out rights, most notably the right to opt out of the "sale" or "sharing" of personal information. This policy is intended to satisfy those disclosure obligations.
By continuing to browse or use the Service, you acknowledge that you have read and understood this Cookie Policy. Where opt-in consent is legally required — for example, in connection with the sale or sharing of personal information for cross-context behavioral advertising, or in connection with tracking children under the age of 13 — we will obtain that consent, or provide a legally sufficient method to withhold it, before the relevant Cookie is deployed.
1. What Are Cookies
Cookies are small text files containing an identifier and other limited data that a website transfers to your browser, which stores the file on your computer, tablet, smartphone, or other internet-connected device. When you return to the Service, your browser transmits the Cookie back to our servers or to the servers of the third party that placed it, allowing the Service to recognize your device, remember your preferences, and function as intended.
Cookies are commonly classified by their source and duration. "First-party Cookies" are placed by Otavite and are readable only by us. "Third-party Cookies" are placed by service providers, analytics vendors, advertising networks, or other partners with whom we work, and are governed by those third parties' own privacy and cookie policies. "Session Cookies" exist only for the duration of a browsing session and are deleted when you close your browser, while "Persistent Cookies" remain on your device for a defined period or until you delete them.
In addition to Cookies, we may use related technologies that perform comparable functions, including web beacons (also called clear GIFs or pixel tags), JavaScript tags, local and session storage, mobile advertising identifiers, and server-side logging. Where this policy refers to "Cookies," it refers collectively to these technologies. Some of these technologies may observe your interaction with the Service, and certain third-party tracking technologies may be construed as "interception" of communications under statutes such as the Electronic Communications Privacy Act, 18 U.S.C. § 2511 (which has limited application to ordinary website analytics), and state wiretapping and invasion-of-privacy statutes such as the California Invasion of Privacy Act (Cal. Penal Code § 631). We do not use session-replay or keystroke-capture technologies to collect data from input fields, and our analytics are configured to exclude sensitive data.
For the avoidance of doubt, this Cookie Policy does not govern the practices of third parties operating outside of the Service, even where we link to their websites. You should review the cookie and privacy notices of any third-party site you visit.
2. Types of Cookies We Use
We use the following categories of Cookies on the Service. The specific Cookies deployed may change from time to time as we update the Service, and a current list of active Cookies — including the provider, purpose, category, and retention period of each — is available through our Cookie Preference Center, which can be accessed from the cookie banner displayed on your first visit and from the footer of otavite.info.
- Strictly Necessary Cookies — required for the Service to operate, authenticate users, and maintain security.
- Functional and Preference Cookies — remember your settings, language, region, dashboard configuration, and previously entered information.
- Analytics and Performance Cookies — help us understand how the Service is used so we can improve performance, reliability, and usability.
- Marketing and Advertising Cookies — support advertising, remarketing, conversion measurement, and cross-context behavioral advertising.
- Social Media and Integration Cookies — enable embedded content, single sign-on, and sharing features offered by third-party platforms.
Where required by applicable law, Cookies that are not strictly necessary will not be set until you have been presented with notice and an opportunity to accept or decline them. Because there is no general statutory consent requirement in the United States, our default posture is that non-essential Cookies may be set following disclosure, subject to your right to opt out at any time, and subject to your browser's or device's transmission of a Global Privacy Control ("GPC") opt-out preference signal.
We retain Cookie data only for as long as necessary for the purposes described in this policy, after which such data is deleted or de-identified. Retention periods vary by Cookie and are disclosed in the Cookie Preference Center.
3. Essential Cookies
Strictly necessary Cookies are essential to the operation of the Service and cannot be switched off through our Cookie Preference Center. They are typically set in response to actions you take that amount to a request for services, such as logging into your account, establishing an authenticated session, navigating between pages, submitting forms, completing a checkout, or adjusting your privacy settings.
Examples of essential Cookies include session identifiers that maintain your logged-in state; load-balancing Cookies that distribute traffic across servers; security tokens that protect against cross-site request forgery and cross-site scripting; fraud-prevention and bot-detection identifiers; and Cookies that record your Cookie preferences so that we do not repeatedly prompt you. These Cookies do not typically collect information that identifies you personally beyond what is necessary to authenticate and secure your session.
Because essential Cookies are necessary to provide the Service you have requested, disabling them through your browser may render the Service inoperable or cause significant portions of it to malfunction. We do not treat information collected through strictly necessary Cookies as "sold" or "shared" under the CCPA as amended by CPRA, because that information is used solely to provide the Service and not for cross-context behavioral advertising.
Certain essential Cookies may also support compliance functions, including recording the version of this Cookie Policy and the Privacy Policy that was in effect when you provided or withheld consent. Records of your choices are retained for the period necessary to demonstrate compliance with applicable law.
4. Analytics Cookies
We use analytics and performance Cookies to collect information about how visitors and users interact with the Service — for example, which pages are visited most frequently, how users navigate through the product, how long sessions last, and which features generate errors. This information helps us diagnose technical problems, measure the effectiveness of product changes, and prioritize improvements.
Analytics data is generally aggregated or de-identified before it is used for reporting and product development. Where we use third-party analytics providers such as Google Analytics, we configure those tools to limit data collection and retention, to disable data sharing for advertising purposes where available, and to avoid transmitting sensitive or confidential customer content. We do not use analytics Cookies to build advertising profiles of individual users, and we do not permit our analytics providers to use data collected on the Service for their own independent marketing purposes.
Where analytics Cookies are used for purposes that constitute "sharing" for cross-context behavioral advertising under the CCPA as amended by CPRA (Cal. Civ. Code § 1798.140(ah)), we either disable that functionality or treat the activity as a share subject to your right to opt out. If you transmit a GPC opt-out preference signal, we will honor it by disabling non-essential analytics and marketing Cookies on our part to the extent required by Cal. Civ. Code § 1798.135 and applicable state law.
You can limit analytics Cookies through the Cookie Preference Center or by using the controls described in Sections 7 and 8 below. Please note that disabling analytics Cookies does not prevent the Service from collecting strictly necessary operational and security logs.
5. Marketing Cookies
Marketing and advertising Cookies allow us and our advertising partners to deliver relevant advertisements to you on and off the Service, to measure the effectiveness of our campaigns, to limit the number of times you see an advertisement, and to attribute conversions, sign-ups, and purchases to the campaigns that generated them. These Cookies may be used to create interest-based profiles and to deliver advertisements based on your activity across websites and applications over time.
Under the CCPA as amended by CPRA, the disclosure of personal information to a third party for cross-context behavioral advertising — whether or not for monetary consideration — constitutes "sharing," and disclosure of personal information for monetary or other valuable consideration constitutes a "sale." Both are subject to your right to opt out under Cal. Civ. Code § 1798.120 and to our corresponding obligations under Cal. Civ. Code § 1798.135. Comparable opt-out rights exist under other state comprehensive privacy statutes, including the Virginia Consumer Data Protection Act (Va. Code § 59.1-575 et seq.), the Colorado Privacy Act (C.R.S. § 6-1-1300 et seq.), the Connecticut Data Privacy Act (Conn. Gen. Stat. § 42-515 et seq.), the Utah Consumer Privacy Act (Utah Code § 13-11-101 et seq.), and the comprehensive privacy laws of Texas, Oregon, Montana, Florida, Tennessee, and other states.
You may exercise your right to opt out of the sale or sharing of personal information at any time by clicking the "Do Not Sell or Share My Personal Information" link available in the footer of otavite.info, by adjusting your choices in the Cookie Preference Center, or by contacting us using the details in Section 10. You do not need to create an account to exercise this right, and we will not discriminate against you for doing so. We honor opt-out preference signals, including the Global Privacy Control, where required by law.
We also participate in industry self-regulatory programs and honor opt-out elections made through the Digital Advertising Alliance ("DAA") WebChoices tool and the Network Advertising Initiative ("NAI") opt-out platform. Because these mechanisms rely on Cookies, clearing your Cookies may reset your opt-out election, and you may need to renew it. We do not knowingly permit behavioral advertising or marketing Cookies to track children under the age of 13, consistent with the Children's Online Privacy Protection Act and the COPPA Rule as amended effective June 2025 (16 C.F.R. Part 312).
6. Third-Party Cookies
Certain Cookies on the Service are placed by third parties, including payment processors, customer support and chat providers, analytics vendors, content delivery networks, customer relationship management platforms, identity and authentication providers, and advertising networks. These third parties may collect information about your online activities across the Service and, over time, across other websites and applications. We select vendors that we believe maintain appropriate data protection practices and we contractually restrict their use of data where feasible.
Third-party Cookies are governed by the privacy and cookie policies of the third parties that set them, not by this Cookie Policy. We do not control those third parties' tracking technologies, their retention practices, or their onward disclosures, and we therefore encourage you to review their policies directly. Where a third-party vendor collects information on our behalf as a service provider or processor, that collection is addressed in our Privacy Policy.
Disclaimer Regarding Third-Party Cookies
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Otavite PROVIDES THE SERVICE AND ALL RELATED FUNCTIONALITY ON AN "AS IS" AND "AS AVAILABLE" BASIS, MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THIRD-PARTY COOKIES OR THE PRACTICES OF THIRD PARTIES, AND DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Otavite SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE USE OF THIRD-PARTY COOKIES OR TRACKING TECHNOLOGIES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Nothing in this section limits any right you may have under applicable federal or state law, including rights under the CCPA as amended by CPRA, the FTC Act, or applicable state comprehensive privacy statutes.
7. How to Control Cookies
You have several mechanisms available to control Cookies. The primary method is our Cookie Preference Center, accessible from the cookie banner on your first visit and at any time from the footer of otavite.info. The Preference Center allows you to review each category of Cookies, accept or reject non-essential categories, and withdraw or modify your choices. Changes take effect immediately, although Cookies already placed on your device must be removed through your browser settings.
You may also opt out of the sale or sharing of personal information by using the "Do Not Sell or Share My Personal Information" link in the footer of otavite.info, by emailing [email protected], or by calling +13016622683. If you use a browser or extension that transmits a Global Privacy Control opt-out preference signal, we will treat that signal as a valid request to opt out of the sale or sharing of personal information and will apply it to the browser or device from which it is sent, as required by Cal. Civ. Code § 1798.135 and applicable state law.
Additional opt-out mechanisms include the DAA's WebChoices tool, the NAI opt-out platform, and the advertising preference tools offered by individual platforms. On mobile devices, you can reset or limit your advertising identifier through your device settings (for example, "Allow Apps to Request to Track" on iOS or "Ads" settings on Android).
Because United States law does not impose a general opt-in requirement for Cookies, we may continue to set essential and functional Cookies regardless of your elections; your elections govern analytics, marketing, and other non-essential categories. Where you have elected to reject a category, we will suppress the corresponding Cookies on a going-forward basis and will not re-prompt you for a period of at least twelve months unless you clear your Cookies or our records indicate a change in your preferences.
8. Browser Settings
Most browsers allow you to refuse, delete, or block Cookies through their settings menus. Browser Help pages typically provide instructions for managing Cookies: Google Chrome (Settings → Privacy and security → Third-party cookies), Apple Safari (Preferences or Settings → Privacy), Mozilla Firefox (Settings → Privacy & Security → Cookies and Site Data), and Microsoft Edge (Settings → Cookies and site permissions). Mobile browsers offer comparable controls, and private or incognito browsing modes generally discard Cookies when the session ends.
Blocking or deleting Cookies may materially affect your experience. Strictly necessary and functional Cookies support authentication, session continuity, security, and preferences; if you block them, you may be unable to log in, retain settings, or use core features of the Service. Blocking Cookies may also cause your opt-out preferences to reset, requiring you to renew them.
Some browsers offer a "Do Not Track" ("DNT") signal. There is no industry consensus or uniform legal standard for interpreting DNT signals, and we do not currently respond to DNT signals. We do, however, honor Global Privacy Control signals as described in Section 7, to the extent required by applicable law.
You may also adjust settings within the Service itself, including notification preferences, email marketing preferences, and third-party integration permissions. These settings operate independently of Cookie controls and may not prevent all tracking.
9. Updates to Policy
We may update this Cookie Policy from time to time to reflect changes in the Cookies we use, changes in technology, changes in applicable law, or changes in our business practices. When we update the policy, we will revise the "Last Updated" date at the top of this page and, where the changes are material, we will provide additional notice — such as a prominent banner on the Service or an email to the address associated with your account.
Material changes may include the introduction of new categories of Cookies, the addition of new third-party vendors engaged in cross-context behavioral advertising, or changes to the methods by which you may exercise your opt-out rights. Where required by applicable law, we will obtain consent to material changes before they take effect; otherwise, your continued use of the Service after the effective date of an updated policy constitutes your acknowledgment and acceptance of the revised policy.
We encourage you to review this Cookie Policy periodically and to consult the Cookie Preference Center, which reflects the most current list of active Cookies and their purposes. Prior versions of this policy are available upon request by contacting us at [email protected].
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF Otavite, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS ARISING OUT OF OR RELATING TO THIS COOKIE POLICY OR THE USE OF COOKIES ON THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO Otavite FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY ASSERTED AND EVEN IF A LIMITED REMEDY IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE FOREGOING LIMITATIONS MAY NOT APPLY TO YOU.
